Written question - BEREC implementation guidelines for Regulation (EU) 2015/2120 - public consultation - P-000299/2016: "Regulation (EU) 2015/2120 on open Internet access and roaming was adopted on 27 November 2015.

As specified in Article 5(3) of the regulation, the Body of European Regulators for Electronic Communications (BEREC) shall issue the requisite implementation guidelines ‘after consulting stakeholders and in close cooperation with the Commission’.

This puts BEREC is in the same situation as that of the United States Federal Communications Commission (FCC) when it conducted a similar consultation. In the course of that exercise, the FCC received more than 3.7 million comments. In the instance at hand, however, once the public consultation has been launched (in the beginning of June 2016),

BEREC will only have a few weeks to assess the comments received, make any necessary changes and complete the internal procedures, if it is to adopt a revised position by the end of August 2016. This very short period of time for processing potentially tens of thousands of responses poses the risk not only of undermining the credibility of the process, but also of creating a strong incentive for BEREC to avoid making significant changes — however necessary they may be.

 Bearing this in mind, can the Commission provide an assurance that it will show some flexibility with regard to the given deadline, should it prove necessary for BEREC to delay the publication of the guidelines, as this would be to the benefit both of the credibility of the outputs of the process and of the online ecosystem in Europe?" 'via Blog this'
